Heating in all bedrooms The kitchen is a good size fully fitted kitchen with washing machine, tumble dryer fridge freezer, microwave and electric oven with gas hob. The lounge and dining room is well furnished with Sky TV, CD/Tape Recorder/Radio, DVD and Video. Sun terrace off lounge. Heating for winter months There are 3 terraces - 2 Sun terraces with table, chairs and sunbeds, sea and mountain views. Large BBQ terrace with outside sink unit. Booking Terms & Conditions

Your contract is with Andalucian Villas Ltd

1.  Your holiday contract

When you ( the Client ) make a booking you guarantee that you have the authority to accept and do accept on behalf of your party the terms of these booking conditions. Your contract with Andalucian Villas Ltd ( the company ) is made when a confirmation invoice has been issued to you.

It is a condition of our company and clearly stated on the "Booking Form" that "All passengers must have insurance", that is those passengers listed on the booking form and whom the Client has stated will occupy the property during the rental period. Your booking will only be accepted if you have indicated on the booking form that you and your party have or intend to take out holiday insurance. We cannot be responsible for your costs if you fail to so. For your own peace of mind the insurance should cover you if you have to cancel your holiday or for any emergencies which arise while you are away.

Your contract with us will be governed by English Law and is subject to the jurisdiction of the English Courts at all times.

2. Booking Procedure

When a booking is made.

  1. When a booking is made, the Client ( i.e. a person on the booking form and the person who has signed the booking form) is required to send a deposit representing 25% of the accommodation cost, together with a completed booking form. If the booking is made within 8 weeks before the rental period commences then the full amount of the holiday cost is to be paid.
  2. The client will then receive a confirmation account stating the deposit paid, the details and requirements of the booking and the date when the balance of payment is due, which is usually 8 weeks before the rental period commences.
  3. A confirmation letter will be sent on receipt of the balance of payment.
  4. Approximately 2 to 3 weeks before rental period commences a holiday package will be sent to the client, this package will include key details, taxi / minibus, car hire arrangements (if required), photographs and map to assist in locating the property, contact details, emergency numbers and general information.
  5. A breakage, damage, return of keys deposit is required for some properties; this is fully refundable on our agents certification and the safe return of the property keys.

Conditions

3. If you change your booking

If, after our confirmation invoice has been issued, you wish to change your holiday booking in any way, we will do our utmost to make these changes but it may not always be possible.

  1. Any request for changes to be made to accommodation, party members or booking dates must be in writing from the client. You will be asked to pay an administration charge of £25.00 if your request can be accommodated. If these changes represent a new booking, then a new booking form must be completed. A new confirmation invoice will be issued and the previous booking will be cancelled. Any monies previously paid by the client will be transferred to the new booking; if any payment to the deposit or balance of payment is required then the client will be made aware of this at the time the request for a change of booking was made.
  2. Any request for changes to be made to services provided in Spain such as car and taxi hire, cot hire additional beds etc. can be made by telephone and if any additional payment is necessary then this can be added to the balance of payment.

4. Holiday Booking Cancellation

Should you wish to cancel your booking, written notification must be received from the lead name on our confirmation invoice ( the Client ) as soon as possible. The following charges will apply from the date on which written notification is received by Andalucian Villas Ltd:-

Cancellation by the Client
 

  1. More than 3 months before the rental period commences, Andalucian Villas Ltd (AVL) will retain 50% of the deposit.
  2. Less than 3 months but more than 8 weeks before the rental period commences, AVL will retain 100% of the deposit.
  3. Less than 8 weeks before the rental period commences, AVL will retain 100% of the payments received unless another booking can be secured for the same period in which case only the initial deposit will be retained.
  4. Any cancellations must be made by telephone in the first instance, and then confirmed in writing.

If AVL change or cancel your holiday

If in the unlikely event that Andalucian Villas Ltd has to change the holiday accommodation for whatever reason you may then:

  1. accept the changed arrangements;
  2. cancel your booking completely, in which case we will refund you all monies paid by you to Andalucian Villas Ltd.

Non-Payment of Balance of Payment
 

  1. If within 7 days of the date shown on the Confirmation Account the balance of payment has not been received by AVL and after AVL has contacted the Client about the non-receipt of payment, AVL reserves the right to cancel the holiday booking by informing the Client in writing of its decision. This clause may not apply if the non receipt of the payment was caused by the postal services.

5. Your Rented Accommodation

This is reserved exclusively for the people named on the booking form and no other persons are permitted to stay at the accommodation unless this has been agreed with us in writing and appropriate payments made (if applicable).

At the start of your holiday, your accommodation will be cleaned and supplied with fresh towels and linen and beds will be made up.

The accommodation will be thoroughly inspected prior to your arrival, and safety checks will be carried out on furniture and fixings; any item found to be defective or unsafe will be repaired or replaced.

It is the responsibility all those persons occupying the accommodation to conduct themselves in a proper manner and with due regard to health and safety, comfort and enjoyment and general well-being of all persons who may be occupying neighbouring properties or are involved in the provision of any service or facility relating to the accommodation. Should you or any member of your party be responsible for any breakages, loss or damage of any item of the property or if additional cleaning has been necessary, a charge will be made locally or an invoice will be sent to you on your return to the UK . This will be deducted from your “Breakage/Damage” deposit where applicable. Any such breakages, loss or damage caused must be reported to our resident agent immediately.

If, in the opinion of ourselves, the local agent, accommodation owner or other person in authority you are, or appear to be, behaving in such a way to cause danger or damage to the property or distress to others; either the local agent or ourselves may terminate your holiday arrangements and you will be required to vacate the property. In this event we will have no further liability to you and will not be responsible for any expenses you incur, any refund or any compensation. In addition you will be responsible for any additional expenses we may incur as a result of your behaviour.

Our local agent or any person authorised by that agent shall be entitled to enter the accommodation to carry out necessary inspection, maintenance and repair work or for any purpose associated therewith.

6 . Special Requests

If you have a special request please inform us at the time of booking your holiday and we will do our best to comply, but cannot guarantee to do so and it will not form part of our contracted obligations. Special requests made after your booking date must be confirmed in writing.

7. If you have a complaint

If you have cause for complaint whilst on holiday, this must be brought to the attention of Andalucian Villas Ltd's local agent immediately so that action can be taken to rectify the problem. Should the local agent be unable to resolve the matter, details of the complaint must be notified to Andalucian Villas Ltd in writing within 28 days of the end of your holiday. We will not consider any claims received outside this period.

8.. Data Protection Policy

In order to process your booking and to ensure that your holiday accommodation arrangements run smoothly and meet your requirements we need to use the information you provide such as name, address, any special needs etc. We take full responsibility for ensuring that proper security measures are in place to protect your information. We must pass the information on to the relevant suppliers of your arrangements such as villa management companies, transport companies etc. The information may also be provided to public authorities such as customs/immigration if required by them, or as required by law. We will not however pass any information onto any person not responsible for part of your holiday arrangements. In making your booking, you consent to this information being passed on to the relevant persons.
